I would try it in another, but Mrs F's PC won't stand a chance of running it, and getting it into my mate's PC would b@gg@r up his PC as he's running an Asus card with all the driver fun that would entail.

It's in hand, I've quoted the SoG Act at them and they're just not interested. So once I've checked the card myself, it's time to go all legal on their donkeys.

Good news... My replacement G9 mouse arrived from Amazon today, so once I've transferred the non working one to the packaging and boxed it up, stuck on the postage paid label and sent it back, I'll be a happier bunny. Amazon are the way to go in the future for me.

I know a few people who have had a similar experience with overclocks in the past sadly, so I simply refuse to purchase from them.

That said I recall a time some years ago when they were banning whole swathes of people from their internet forums just because they were associated with the forums from another company. I'm sure this has no relevance or bearing on how the operation is currently run (it may have even changed hands, who knows) but when you are parting with your hard earned cash it's a case of once bitten twice shy.

It's such a shame that Komplett shut down their operations, they were by and large one of the best companies I ever had the problem doing business with, along with Tekheads. Scan and Aria are both good as well. Overclockers are with Dabs on my "do not use" list.

Gary, sorry to hear of your troubles with Overclockers, if the card still does not work and they have stated there is nothing wrong with it then I would suggest that before you take any action against them have a professional look at your computer and graphic card, this will of course cost something but should any fault be found with the card then get them to write out a full description so that it can be used against Overclockers if it is found to be faulty.

Regards and good luck.

That sounds like good advice, Nigel. As you know, Gary, you only have 7 working days to return an item bought on the internet that you don't want for whatever reason (cooling off period) - other than that it's faulty or they've mis-sold it. They are under no obligation to exchange or refund it after that. If it's faulty, however, then the Sale of Goods Act says that it must be fit for purpose and the retailer will have to repair, exchange or refund the item. They've said it's OK so now you have to prove that it isn't. If you can't do that you're stuck with it.

That's what the law says (according to Which? Online) but nowadays we're used to companies offering more than they are required to do in order to keep customers. Overclockers have now lost several customers from this forum because of this attitude and far more profits than the money they've saved by not refunding you. What a way to run a business! Good luck!

I have to agree, I think I will be in the buyer beware bracket... Shame as they are not so stupid to think there are other on line retailers out there. I have used CCL and Scan .

Yep, it's all in hand. I'll have to get it to PC World and get a report on it from them. If it's not faulty then I'll see about getting them to get it working in my PC. I'm waiting on overclockers sending me the engineers report that I paid them £10 for to see what they used to test it and how it was tested. It's all gone quiet since I asked for that though...

Gary, I myself am a bit surprised that Overclockers charged you £10 for an engineers report, if anything is sent back to the supplier with a fault known or otherwise, then I would have thought it was the supplier of the goods to give you the report as they would have had it tested to determine whether there was a fault and should be able to supply their findings with no fee.

Also the following may be of help to you should the card be found to be at fault.

If something proves to be faulty within the first six months from when you buy it, the law assumes it was faulty at the date of purchase and the onus will be on the trader to show that actually you were at fault, for example, by dropping or failing to properly maintain the item.

I have had a lot of experience not only with faulty goods but also with goods sold to me that actually turned out to be 'not fit for purpose' i.e. well known car dealership stating 2nd hand car I was buying was owned by........and found after receiving the log from DVLA it had been owned by another company instead...... I got a full refund without the help from third parties.

If your card proves to be faulty then make sure you send them the copy only of the engineers report retaining the original yourself, should you not get any satisfaction from Overclockers then contact Trading Standards Office informing them of your complaint, they will then issue you with an incident number. then you must find out who the owner or managing director of Overclockers is and write to him personally stating that Trading Standards have been informed and will take action on my behalf if no response is made within 14 days on receipt of this letter, also state that legal action will be taken against their/his/her company within the Small Claims Court to recover the amount paid for the faulty card and also additional expenses such as engineers report travelling costs and loss of income (if having to take the day off work). Make sure that the letter is sent by recorded delivery, believe me, I have used this method successfully a number of times and once they realise that you mean business they usually back straight down.

All the best and keep us informed.

Regards
Nigel.

Don't know how current the procedures given in this article are but worth a look:

No news other than I have a £200 paperweight. They won't budge, and I'm waiting on getting the card tested in a mate's PC.
