XR219 - I think you will find that , unless it has changed, by virtue of S.22 of the Copyright Act 1956 , it was a specific criminal offence to distribute for gain , copies of copyright material without the consent of the owner . This appears to me to cover the very situation which Marty has experienced . Although UK Law has been altered somewhat by the 1988 Act, and also by regulations made under the European Communities Act 1972, the law of Australia in Marty's casemay well still be analogous to the UK situation pre-1988

Hi Chris,

It was just some info I'dgleened from a layer friend in Brighton, I'm not in the profession myself, so wouldn't know for sure. ;-)

Please don't get me started with FSPlanet :@

If i can find the e mail i got back last time i asked them not to break my copyright :o

it was very rude and they have no interest in what anyone wants
but they continue to break the law because nobody ever bothers to prosecute them.

Pretty sure the original FSPlanet owner lives in the same Spanish town as Trev does now. (Ferdy was approachable and would remove my files if i asked him to)
But sadly he is no longer involved in FSPlanet. :-(

received the following email from FSPLANET today
Hello,

Some people has told us that your website or repaints are posting defamatiory comments against our website (Not to be uploaded to FSPLANET.COM).

Sirs, we and some other webmasters have been fighting during the last 2 years against this kind of comments and make differences between sites, like who can and/or who cannot.

There's a very nice thing called EMAIL. instead to post these kind of messages against the community to create enemies or differences, just EMAIL US and say us... please do not post our repaints (We don't care the reason why)... just simply CONTACT WITH US and LET US KNOW by email.... and not by posting NOT FOR... xxxx

We do not upload files from anywhere, but we just upload only the files that are being uploaded in our servers. We don't know if these files are being uploaded by the authors, by repainters or by anybody else. We don't know from where the files are coming from. We had terrible problems in the past due some bad people were uploading files to our servers, and then we were accused as stealers. That's COMPLETELY FALSE.

I ask you to remove all these comments about (not for fsplanet.com) from all your files. We will be sure that not to upload any more files from UKMIL if any is uploaded to our servers, but at the same time I ask you the right to remove these comments against our website.

Let me know as soon as possible. Thank you!

Now, as the OWNER and AUTHOR of UKMIL files, i would I DECIDE where these are uploaded!!

even tho we HAVE emailed FSPLANET on numerous occasions asking them to remove our files, they are still posting them

our FSX sea harriers are on there right now!!

Sir, there are more than 8 people working here, and we don't know if all of them has read your emails (as far as I remember I have not received any email from you).
I want to know if you want to resolve this pacefully or not. Let me know as soon as possible.

mm, me thinks he does not know anything, how can they take UKMIL to court, for making a statement, that we do not want our files uploaded to their server!! i think not
I am in charge since 10 months ago, and as I said you, we are a team of 8 people here, working with the website, servers, sponsors, our scenery designers...etc.

I don't know absolutely nothing about the problems you had withthe previous person who was in charge here in Fsplanet.com (probably Ferdy Serena).

If you wast that I personally find all the files from UKMIL and I remove all of them from our servers, I'll do it so. As I said you, I don't care the reason you don't want that your files be published at our website, in fact we don't have nothing to lose, as we will have the same amount of visitors, and many people will don't know about your files or your website because they will simply will do not download from our website. But that's not the matter now.

As I said you, I can lookfor all your files and delete them from our servers. At the same time I'll inform to all my team (tomorrow) to be carefull about all files signed with UKMIL. If any is uploaded, simply we will remove it before to announce it.

At the same time I ask you to edit all your readme's and remove NOT FOR FSPLANET.COM or whatever about our website and reupload where you have uploaded these files.

If you agree with it, perfect. If you don't, then we will be forced to call our solicitors Brethertons.co.uk to resolve this situation (as they did with some other people in the past). As you can see, at this moment, you're the ONLY one posting messages like NOT FOR.... xxxx

their latest response to above, shows they have no legal team at brethertons
If you continue, we will upload ALL YOUR FILES AT ONCE!

I actually spoke to the legal firm they quoted, who are in the UK, and as mentioned, FSPlanet are registered in the USA, but ran from spain, and suprisingly, Brethertons had never heard of them STUPID

seems the christian geezer was just a stupid kid, who found a UK based legal firm on google to try and threaten me

The statement that you are the only ones saying not to be uploaded to FS planet is not true as I know of at least one other site that has that in their read me's
